Your order is not accepted until we process your payment and confirm acceptance. Please review your order carefully — because our products are personalized, we may be unable to accommodate cancellation requests after an order is accepted.

Prices are listed in US Dollars (USD). Shipping is charged separately as a flat rate shown at checkout. For orders shipped Delivered Duty Paid (DDP), applicable import duties and local consumption taxes are prepaid on your behalf and included at checkout.

For orders shipped Delivered Duty Paid (DDP), import duties, customs fees, and local taxes are prepaid on your behalf, and no additional charges are collected on delivery. Where an order is not shipped DDP, any such charges assessed on import are the recipient’s responsibility.

We are not liable for shipping and delivery delays. All delivery times are estimates only. Once we transfer products to the carrier in Japan, title and risk of loss pass to you. For more details, please refer to our Shipping Policy.

All trademarks, text, images, and designs on the Services are owned by Kawaii Labels, its affiliates, or licensors and are protected by international copyright and intellectual property laws. You may use the Services for personal, non-commercial use only.

Kawaii Labels is powered by Shopify. However, any sales and purchases you make are directly with LESTAS Co., Ltd. Shopify is not responsible for any aspect of the sales or products.

You are prohibited from using the Site or its content for any unlawful purpose, to infringe upon intellectual property rights, or to upload viruses or malicious code. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

Except as expressly provided below, the Services and all products are provided ‘as is’ without any warranties of any kind. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE 7-DAY PERIOD FOR REQUESTING EITHER A REPLACEMENT OR REFUND UNDER OUR REFUND & RETURN POLICY. In no case shall Kawaii Labels, LESTAS Co., Ltd., or our directors and employees be liable for any direct, indirect, or consequential damages arising from your use of the Service. Nothing in this section shall limit or exclude any liability that cannot be limited or excluded under applicable law.

For defective, damaged, or incorrect items, the limited remedy we provide — a free replacement, or a refund at our discretion — is described in our Refund & Return Policy. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages; in those jurisdictions, such warranties and rights apply to the extent required by law.

You agree to indemnify and hold harmless Kawaii Labels, LESTAS Co., Ltd., and Shopify from any claims arising out of your breach of these Terms of Service or your violation of any law.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict-of-law principles.

Dispute Resolution by Binding Arbitration and Class Action Waiver 1. Binding Arbitration: You and LESTAS Co., Ltd. agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, our products, or the Services shall be resolved exclusively by binding arbitration, except that you may assert a claim in small claims court, if your claims qualify. 2. Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

For any disputes that are not subject to binding arbitration, you and LESTAS Co., Ltd. consent to the exclusive jurisdiction and venue of the courts located in Osaka, Japan. If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country or state of residence, and these governing-law and venue provisions apply only to the extent permitted by those laws.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
